The Supreme People's Court Set Up Intellectual Property Judicial Protection Research Center in Beijing

 
In the morning of March 18, the Intellectual Property judicial protection research center of the Supreme People's Court was set up in Beijing.

Zhou Qiang emphasised that we shall actively take advantage of new features and trends of IPR judicial protection in the new economic normal, and strengthen the theoretical research and innovation of it,to creatively promote the continuous development of theoretical system of IPR judicial protection in China and the healthy development IPR trial, so as to provide effective judicial protection for promoting innovation-driven development strategy and accelerating the construction of innovative country.

In the morning, Zhou Qiang inaugurated the Intellectual Property judicial protection research center, and presented the letter of appointment to the first session of academic committee members and researchers of the Center.

 
 
China¡¯s application for international patent increased fastest in 2014

 

The World Intellectual Property Organization released the latest report on March 19, in 2014 Chinese companies submitted a total of 25,539 international patent applications in the framework of "Patent Cooperation Treaty" (PCT), with an annual growth rate of 18.7%, which is the only country with double digit growth in the world.

According to statistics, the United States remains the largest country with PCT international patent applications, with 61 492 in 2014, accounting for 28.7% of the global amount, followed by Japan with 42,459, accounting for 19.8%, and China ranked third, accounting for 11.9%.

The report said that China's Huawei Technologies Co., Ltd. applied for 3442 patents, becoming the largest applicant in 2014. Qualcomm of the U.S. ranked the second, and China's ZTE ranked the third.

In addition, Tencent Technology, Shenzhen CSOT, BOE and Huawei Terminal ranked the 17th,23th,34th and 46th respectively.

 
 
"Patent Agency Management Rules (draft)" for public comment

 
On March 24, it was informed by China's State Intellectual Property Office that the ¡°Patent Agency Management Rules (draft)¡± (hereinafter referred to as "draft") drafted by it, has been soliciting public comment since March 24.

According to the report,one of the main modifications of the "draft" is to abolish capital requirements for establishment of patent agency. At the same time, it modifies relevant provisions of standardizing the establishment of patent agency and the change of bibliographic items, and of strengthening the supervision of patent agency industry.

It is understood that the current "Patent Agency Management Rules" has been implemented since July 15, 2003. After careful investigation and on the basis of practical experience, the State Intellectual Property Office modifies and drafts the "Patent Agency Management Rules (draft)." It is reported that the public may feed back written comments and suggestions via e-mail, fax, letter, etc. to the Treaty and Law Department of State Intellectual Property Office before April 14, 2015.

 
 
Employment Invention Regulations (draft) for public comment

 
On April 2, the State Council Legislative Affairs Office solicits public comment for the ¡°Employment Invention Regulations(draft)¡± reported by the State Intellectual Property Office and Ministry of Science & Technology for consideration.

According to report, the draft has a total of seven chapters and forty-four articles, making provisions of duty invention system in many aspects such as the right of ownership of the invention, the invention report and application for Intellectual Property, reward and remuneration for inventors, implementation,supervision and inspection and legal responsibility of promoting employment invention Intellectual Property.

It is understood that the employment invention system is the basic system of adjusting its right of ownership and interests distribution, which is directly related to the initiative of technology innovation and transformation by technologists and their units. The State Intellectual Property Office jointly launched the drafting of the regulations with relevant authorities like the Ministry of Science and Technology in 2010, on the basis of in-depth investigation, public opinions and repeated demonstration, the " Employment Invention Regulations(draft)" is formed and submitted to the State Council for consideration.

According to the notice in the website of State Council Legislative Affairs Office, the relevant units and communities can make comments by logging China Legislative Information Net, letters or e-mails before May 2, 2015.

 
 
Draft amendments to the Patent Law for public comments

 
On April 1, the "Draft amendments to Patent Law (draft)" (hereinafter referred to as the draft) presided by the State Intellectual Property Office solicits for public comments.

Officials from SIPO Treaty and Law Department said that the draft has a total of 30 substantive changes, including 18 modifications to the existing provisions, 11 additions, 1 deletion and added the chapter of "Implementation and use of patent¡±, besides to two provisions of adaptation editorial changes or adjustments.

According to reports, the main contents of modification include improving patent protection, safeguarding legitimate interests of right holders; facilitating the implementation and use of patents to realize their value; achieving the statutory functions of the government and building a service-oriented government; improving patent examination system and the quality of patents; improving the legal system of patent agency to promote healthy development of IP services. Among them, in terms of improving patent protection and safeguarding legitimate interests of right holders, the main contents include, intending to further improve the patent protection system with Chinese characteristics, as for strengthening patent protection and law enforcement, as well as issues generally complained by patent holders such as the burden of proof, long period, high cost, low compensation and poor results in enforcement, proposing appropriate measures to establish a sound long-term mechanism to combat patent infringement, promoting effective convergence of patent administrative enforcement and judicial protection, to improve law enforcement efficiency and reduce the cost of patent rights, and create fair and equitable, standardized and transparent legal and market environment.

Officials from SIPO Treaty and Law Department said that, along with the pace of the reform and opening up, innovation and development, the Patent Law has been modified for three times in 1992, 2000 and 2008 respectively.

 
 
State Intellectual Property Committee under South Korean President Visited Unitalen and Presented Appreciation Award

 
On March 30,Kwun Kui Wou, Secretary of State Intellectual Property Committee under South Korean President, Jung Seihwan, the affairs officer, and Xu Dongxu, Korean Embassy Counselor (for Intellectual Property) visited Unitalen, and issued appreciation card.

Not long ago, the Committee conducted policy studies of the "Intellectual Property of Korean companies". At the invitation of the Committee, Unitalen provided a lot of professional assistance. Therefore, the Committee specifically brought the Korean Embassy Counselor to visit Unitalen and had warm discussion with Unitalen.
