50 Percent of PCT Applications from China Entered National Phase

 
Recently, China's State Intellectual Property Office (SIPO) conducted a comprehensive survey on International Patent applications (the applications under "Patent Cooperation Treaty", namely "PCT" applications) from China entered the national phase. It is disclosed that 50% of the international patent applications from China entered the national phase. Chinese applicants filed 12,373 patent applications from 2000 to 2006, among them 6,416 applications entered the national phase of the Patent Offices of China, the United States, Europe, Japan and South Korea.
 
 
China Actively Supports SMEs in Seeking for Patent Protection Abroad

 
Zhang Yuncai, the Secretary-General of China Intellectual Property Society (CIPS), stated on July 7 that multiple Chinese government departments are working together to support small and medium-sized enterprises (SMEs) in seeking for patent protection abroad as well as provide them with policy, legal, financial guarantees for overseas rights enforcement.

According to Zhang Yuncai, currently, nearly 50 centers for overseas rights enforcement have been established in various provinces and cities across the country, for providing legal aid and support for "going-abroad" enterprises. In order to solve the financial difficulties encountered by SMEs, China's financial sector will allocate 100 million RMB yuan special funds this year to finance SMEs to file patent applications abroad. In addition, for the first time the State Intellectual Property Office (SIPO) issued its products of study on intellectual proterty protection environment of foreign countries, which will be provided as public interest information to Chinese enterprises for helping them in protecting their IP rights overseas more effectively.

Zhang Yuncai also said that, in recent years, China's intellectual property legal system is becoming more unified with international IP laws and regulations, and patent administrative enforcement capabilities are being continuously enhanced, and thus a better intellectual property environment is provided for the investment, trade, research and development of foreign-owned enterprises in China.

 
 
Software Copyright Registrations in China Reached 35,000

 
Software copyright registrations in China remain climbing after 3 consecutive years of rapid growth. According to China Copyright Protection Center, up to June 30, 2010, registrations of computer software copyright in the first half-year totaled 35,062, increasing 24.02% year on year; and registrations of game software copyright grow most rapidly, with the increase of 73.5% to the previous year.
 
 
16,100 Cases of Trademark Infringements Investigated and Prosecuted in the First Half-Year

 
In the first half of this year, applications for trademark registration in China increased sharply, with 759,200 new applications examined and 16,700 trademark review cases concluded. As of the end of June, the total number of trademark registrations in China reached 4,956,440.

At the same time, protection of trademark rights is continuously strengthened. Administration for Industry and Commerce at all levels across China cracked down trademark infringements emphasizing on the protection of the World Expo logo, agriculture-related trademarks and well-known trademarks. In the first half-year, 16,100 raids were conducted with a total value of 451 million RMB.

 
 
EPO Investigation Group Carried Out Investigation in China and Visited Unitalen during Beijing Trip

 
 
To learn more about the situation of Chinese enterprises and their demand for foreign-related intellectual property protection, the European Patent Office paid more visits to and carried out more investigations in China in recent years. During the investigation in China in the June of this year, the European Patent Office focused its Beijing trip on Unitalen. The direct communication and idea exchange with examiners from the European Patent Office, as well as the discussion on and analysis of actual cases, helped Unitalen¡¯ attorneys to have more in-depth understanding of the European patent examination standards and trends , enriched their experience in handling European patent applications, gave authoritative answers to related problems encountered in practice and further improved their capacities of handling patent applications.

 
 
"Foreign-Related Intellectual Property Forum" held in Suzhou, Unitalen Experts Gave Legal Advice to Overseas IP Protection

 
 
"Foreign-Related Intellectual Property Forum" hosted jointly by Suzhou Intellectual Property Office and Suzhou Bureau of Commerce, supported by Beijijng Unitalen Attorneys at Law (Unitalen), Cadwalader, Wickersham & Taft LLP (Cadwalader) and Intellectual Property Office of Suzhou National New and Hi-Tech Industrial Development Zone, was held in Shangri-La Hotel in Suzhou on June 30.

As the largest and highest-level Forum on Intellectual Property held in Suzhou National New and Hi-Tech Industrial Development Zone, the event was given great importance by Suzhou Intellectual Property Office and Suzhou Bureau of Commerce, who invited Unitalen and Cadwalader as co-sponsors. More than 140 people attended the forum, including leaders from Suzhou foreign-related enterprises, delegates from aid agencies for IP protection, organizations engaged in foreign-related IP protection and law firms.
