The British embassy in China gave praise to Beijing Daxing District People¡¯s Court for cracking down on crimes against intellectual property |

On May 18, a thank-you letter was sent from the British embassy in China to Beijing Daxing District People¡¯s Court, showing gratitude to the court for making efforts to crack down on crimes against intellectual property.
In 2010, the criminal case of counterfeiting registered trademark committed by the defendant Liu Zhaolong was tried in public hearing in Beijing Daxing District People¡¯s Court. During the period from March to September, 2009, without the approval of the registered trademark owner Pernod Ricard Group, the defendant Liu Zhaolong purchased raw wine, wine bottle, wine lid, package box, lid sealing machine and etc., produced counterfeits of imported wines such as Chivas, Ballantine, Martell, Hennessy, Royal Salute, etc. in his temporary residence at Haizijiao Village, Huangcun Town, Daxing District, Beijing, and sold them to other places through logistic consignment. The amount involved reached RMB 201507. In September of the same year, the public security bureau seized Liu Zhaolong in the course of inspection. After being tried in Beijing Daxing District People¡¯s Court, the defendant Liu Zhaolong was judged to commit the crime of counterfeiting registered trademark, sentenced to imprisonment for four years, and fined with RMB 150 thousand.
The British embassy in China expressed their deep impression on the timely trial and fair judgment made by Beijing Daxing District People¡¯s Court, and showed gratitude for the efficiency of the court.
The case has been included as one of the top ten China IP judicial cases in 2010.

The white paper American Enterprises in China shows strengthened IP enforcement in China |

On April 26, the American Chamber of Commerce in China released the white paper ¡°American Enterprises in China in 2011¡± in Beijing. The white paper shows that in the past few years, the IP enforcement has been intensified in China step by step. The special campaign launched by Chinese government to crack down on the infringement of intellectual property as well as the production and sales of counterfeit and shoddy products featured to be active and constructive.
According to the white paper, the Survey about Business Environment among 434 member enterprises shows that the operation conditions of American enterprises in China is encouraging. 85% interviewed enterprises enjoyed increased income in 2010, 78% realized profit-making or profit-making to a great extent, 63% made profits higher than that in 2009, 41% had higher profit ratio in China than global profit ratio, 83% planned to increase investment in China in 2011. American enterprises have full confidence in China¡¯s market.

The number of China¡¯s patent applications in Europe was greatly increased by 154% in 2010 |

European Patent Office announced recently that the number of patent applications received in 2010 was increased by 111% in 2010 due to the good trend of global economic revival and reached 235 thousand applications, which was the highest level for 34 years since the establishment of EU. Among them, the number of patent applications from Chinese companies was greatly increased by 154%, that is, 13 thousand applications. Besides, the numbers of patent applications from the EU and the U.S.A. also returned to the numbers before the financial crisis. It is reported that since the EU is the largest consumer market globally, many multinational enterprises choose to register patent in European Patent Office. |

The Chinese intellectual property strategy has made conspicuous achievement after being implemented for three years |

When interviewed on June 3, Mr. HE Hua, Deputy Director of State Intellectual Property Office of the People¡¯s Republic of China, said that since the implementation of the Outline of the National Intellectual Property Strategy for three years, it has achieved good effect, and the driving force of the intellectual property strategy on innovation has been greatly strengthened.
The data provided by He Hua show that last year, the number of patent applications in China exceeded 1 million and reached 1.22 million. Among them, the number of applications for patent for invention patents from domestic applicants reached over 290 thousand, increased by over 127% compared to the year before the last. In the first 4 months this year, the increasing rate of the number of patent applications in China reached around 148%. He Hua said that it can be seen from these data that the innovative energy in China has been stimulated to a great extent, and the intellectual property strategy has played the effective supporting role in changing the economic development mode.
On June 5, 2008, the Outline of the National Intellectual Property Strategy was printed and issued by the State Council. In the outline, it is pointed out that by 2020, China will be built into a country with relatively high level in creation, application, protection and management of intellectual property. The objectives for the coming five years proposed in the outline are as follow. The level of self-developed intellectual property will be greatly improved; the effect of applying intellectual property will be obviously strengthened; the condition of intellectual property protection will be obviously improved; the consciousness about intellectual property of the whole society, especially the market subjects will be generally improved.

Recently, Unitalen Attorneys at Law together with Shanghai Intellectual Property Service Center and Guangdong Intellectual Property Research and Development Center invited expert team composed of chairman and chief administrative judge of International Trade Commission (ITC) and senior lawyers from many famous law firms in the U.S. to hold ¡°The International Seminar on Section 337 Investigation and Countermeasures¡± in Shanghai and Guangzhou respectively. It aimed to analyze Section 337 of the US Tariff Action and the relevant laws about IP litigation, as well as the in-depth impact on enterprises and even the industry in whole, and discussed the feasible and effective countermeasures of enterprises.
After the seminar was successfully held in Hilton Shanghai Hotel on May 26, the meeting in Guangzhou started in Shangri-la Hotel on May 27.
With the largest scale and the highest professional level in South China, this international seminar received over 200 senior executives from nearly 150 enterprises.
