Chinese local courts with proper authorization can be of first instance for trial of patent case |

¡°Decision of the Supreme People's Court about modifying Several Regulations of the Supreme People's Court on Applicable Law of Trial of Patent Dispute Case was announced on April 14. This judicial interpretation shall take effect on April 15, 2013.
This judicial interpretation stipulates that the Supreme People's Court can designate local people's courts to enjoy jurisdiction over first instance of patent dispute in light of specific circumstances. For the local people's courts handling much caseload on patent civil dispute and with ability for case hearing thereof, the judicial interpretation provides a clear legal basis for their jurisdiction of such cases.
It¡¯s learned that ever since the beginning of patent trials by people's courts in 1985, the Supreme People's Court has implemented relatively concentrated administrative measures for trial of patent disputes, i.e. only the intermediate people's courts designated by local intermediate people's court and supreme people's court of provincial people's government. ¡°Several regulations of Supreme People's Court on applicable law of trial of patent dispute case¡± released on June 22, 2001 makes explicit stipulation for it. |
