Patent Examination Guidelines Modification Draft (Draft for Comments) seeks Public Comments |

According to the State Intellectual Property Office, in order to provide patent protection for graphical user interface design, the Patent Examination Guidelines Modification Draft (Draft for Comments) (hereinafter referred to as the Draft) drafted by the State Intellectual Property Office solicits for public comments from October 22, 2013 to November 22, 2013, and the public can feed back to the Office via web, email, fax, letter, etc..
Relevant official of the Law Department of State Intellectual Property Office said, as specified in Chapter III of the first part of current Examination Guidelines, ¡°the patterns shown when the product is electrified, such as the patterns on the electronic watch dial, the pattern on the screen of mobile phone, software interface, etc.¡± are listed into situations where design is not patentable. Such regulations which exclude graphic user interface designs from design patent protection are proposed to be modified. First, delete the existing regulations to eliminate barriers of product design protection of graphic user interface; Second, adjust the situations where design is not patentable to "patterns shown on the display which are irrelavant to human-computer interaction or implementation of product features." This is because not all patterns displayed on product display device shall be given patent protection, e.g. the electronic screen wallpaper and screen which are unrelated to human-computer interaction and product features during the opening process; the graphic layout of website and game interface unrelated to product features. Meanwhile, it is proposed to modify requirements on product design, add provisions on design drawings or photographs and brief descriptions; as for the modification of Chapter V of Part IV of the existing examination guidelines, it is proposed to add provisions on considerations in determining whether the product design is obviously different from the prior art.

On November 11, SIPO Director Tian Lipu met with World Intellectual Property Organization (WIPO) Director General Francis Gurry and his delegation in Beijing. Li Yuguang, deputy director of the State Intellectual Property Office, and Wang Binying, WIPO Deputy Director General attended the meeting.
Tian Lipu pointed out that, with joint efforts of both sides, the preparatory work for China's accession to Hague system went on smoothly, and that he believed China¡¯s accession would promote new vitality to the Hague system which is an important intellectual property service system, and provide better service for the world users.
After the meeting, SIPO and WIPO signed the Cooperation Agreement on Development of Infrastructure Services to Support the Sharing of Patent Examination between World Intellectual Property Organization and the State Intellectual Property Office. |

The 2013 Unitalen Intellectual Property Forum was Held |

In October 17-18, 2013, the 2013 Unitalen IPR Forum was held in Beijing Ritan Hotel and more than 200 people in charge of intellectual property from over 100 companies across the country attended the forum. Supreme Court Announced Eight Typical Cases of IPR Judicial Protection, Including the Ashland Case by Unitalen

In the morning of October 22, the Supreme Court announced eight typical cases of IPR judicial protection, among which the Ashland case of patent infringement and trade secrets by Unitalen is enlisted. Previously Ashland case has been selected into the top ten IP cases of Supreme Court in 2012, top ten typical civil cases of Jiangsu Province in 2012, and the national "Top Ten" IP cases selected in the tenth annual meeting of IPR Professional Committee of All-China Lawyers Association. Once again it proved that this case is fairly representative and influential, and the court's decision will provide reference in similar cases.

In November 4, a strategic cooperation between Unitalen Intellectual Property Agency Co. Ltd. and Zhejiang University of Technology Law School was signed at Unitalen¡¯s headquarter. The two sides reached an agreement on theoretical research and personnel training of intellectual property services, to carry out joint research on major issues in the field of intellectual property and transfer research results into cultivation of intellectual property professionals, for a new pattern in training compound talents in intellectual property.
After discussion, the two sides exchanged views on specific issues, and reached formal agreement on specific content of strategic cooperation.
